Terms of Use of the Healion
Platform for Patients
1. Introduction
1.1 HealionMed OÜ, a company registered with the Estonian Business Register (registration no. 17284775), with its registered address at Tornimäe tn 5, Kesklinna linnaosa, 10145 Tallinn, Estonia (”Healion”), is the developer and operator of the website [healionmed.com] (the “Website”) and of the mobile application (the “App” and, jointly with the Website, the “Platform”).
1.2 In order to use the Platform and request medical appointments (the “Medical Services”), you must accept these Terms and Conditions of Use (the “Terms of Use”). These Terms of Use, together with the Healion Privacy Policy available at [healion.com/privacy-policy], form a binding legal agreement between you (the “User” or “Patient”) and Healion.
1.3 If you are using the Platform on behalf of another individual, you represent and warrant that you are authorized to act on behalf of such person and to accept these Terms of Use on their behalf.
1.4 The Platform and the Services are intended solely for use by individuals who are at least 18 (eighteen) years old. By using the Platform, you represent and warrant that you meet this age requirement.
1.5 By clicking “I accept” or using the Platform, you confirm that you have read, understood, and agree to be bound by these Terms of Use. If you do not agree, do not use the Platform.
1.6 Healion reserves the right to amend these Terms of Use at any time. Changes will be effective once published on the Website. Continued use of the Platform following the publication of changes constitutes your acceptance.
2. Scope of Services Provided
2.1 The Platform enables Patients to search and connect with independent licensed healthcare professionals for remote medical consultations. Healion is not a medical provider, does not give medical advice, and does not supervise or intervene in the clinical practice of any healthcare professional.
2.2 Users may filter available professionals based on country of service, medical specialty, and language spoken. The Platform then displays matching healthcare providers along with their consultation fee.
2.3 Upon selecting a professional, Users can view the professional’s profile, including photo, qualifications, languages, and availability.
2.4 Users may select a suitable date and time slot, and are required to complete a consultation request form, providing: personal identification data, symptoms and reason for consultation, relevant documents or images (e.g., test results). These documents are uploaded securely and used exclusively for the medical consultation. They are not downloadable or retained by the doctor beyond the session.
2.5 Once the request is submitted, the selected doctor may: accept the consultation, propose a reschedule or refuse the request.
2.6 Upon confirmation by both parties, the Patient will be prompted to make payment through Stripe, a third-party payment provider. After payment, the video consultation is officially booked.
2.7 The consultation will be conducted through the Platform’s built-in video tool. Once the consultation ends, it cannot be reaccessed or resumed.
2.8 The invoice for the consultation is to be issued directly by the doctor, via email or another preferred method. Healion does not issue medical invoices.
3. Booking and Cancellations
3.1 A consultation can be cancelled or rescheduled up to 24 hours before the scheduled time without penalty.
3.2 Cancellations made less than 24 hours in advance will result in the full fee being retained.
3.3 If the doctor cancels the appointment or does not attend, the Patient will be offered a new consultation or a refund.
4. Responsibilities and Limitations
4.1 Healion is a technology provider only. All medical decisions, care, documentation, prescriptions, diagnoses, and conduct are solely the responsibility of the healthcare provider.
4.2 Healion does not warrant: the qualifications or availability of providers, the accuracy of information provided by third parties or any treatment outcomes
4.3 Healion does not manage emergency cases. In case of emergency, users must contact local emergency services.
4.4 The Patient is solely responsible for providing complete and accurate information when using the Platform. Healion is not liable for damages resulting from errors, omissions, or inaccuracies in user submissions.
4.5 Use of the Platform for fraudulent or unlawful purposes, including impersonation or misuse of personal data, is strictly prohibited and may result in legal action.
5. Use of Uploaded Files and Clinical Data
5.1 The Platform allows Users to upload medical documents, images, or files relevant to the consultation. These files: are encrypted and securely transmitted, are accessible only to the healthcare provider during the consultation and cannot be downloaded, stored, or shared by the provider outside the consultation context
5.2 Healion ensures that file handling complies with applicable data protection laws, but does not assume responsibility for data once shared with the healthcare professional.
6. Payment and Billing
6.1 The consultation fee is set by each healthcare provider and is clearly displayed on their profile.
6.2 Payment must be made in advance through Stripe, using accepted methods such as credit or debit cards.
6.3 Healion acts solely as a payment intermediary. The platform collects the fee on behalf of the healthcare professional and is not the recipient of the medical service fee.
6.4 Any request for invoices, insurance documents, or reimbursement details must be addressed directly to the doctor. Healion does not handle medical insurance claims.
7. Telemedicine Limitations and Informed Consent
7.1 By using the Platform, the User acknowledges that telemedicine: may not be suitable for all medical conditions, is not equivalent to a physical examination and may result in limitations in diagnosis or treatment
7.2 The User consents to receive healthcare services via video call and accepts the risks associated with electronic communication, including possible interruptions or miscommunications.
8. Privacy and Data Protection
8.1 The User’s data is processed in accordance with the Healion Privacy Policy and the General Data Protection Regulation (GDPR).
8.2 Only data strictly necessary for the consultation, account management, and legal compliance is collected.
8.3 Users can access, correct, or request deletion of their personal data as permitted under GDPR. Requests should be sent to support@healionmed.com
9. Platform Integrity and Security
9.1 Users must not: attempt to access private or administrative sections of the Platform, use automated systems to extract or reproduce data or upload harmful content or interfere with platform performance
9.2 Healion reserves the right to suspend or terminate access in the event of misuse or violation of these Terms.
10. Disclaimers and Limitation of Liability
10.1 The Platform and its contents are provided “as is” and “as available” without warranty of any kind.
10.2 Healion does not guarantee uninterrupted access, and is not liable for: technical issues, third-party failures or errors in medical services provided by independent professionals
10.3 Users accept full responsibility for their use of the Platform and interactions with healthcare providers.
11. Applicable Law and Jurisdiction
11.1 These Terms are governed by the laws of the Republic of Estonia. Any dispute arising from these Terms shall be submitted to the exclusive jurisdiction of the courts of Tallinn, Estonia.
